“Case 1411 is called to session, please stand for the honorable judge Malick.” The police officer said as everyone rose and waited for him to be seated. Once he sat he allowed us to sit before proceeding.
“Prosecution please begin,” Judge Malick stated as he looked expectantly at Scott’s lawyer.
“It is known that Miss White had a child with my client. He left the child with the mother to allow for the best raising, but discovered that the mother,” he said directed toward me. “has recently started to date a felon, this puts the child in danger and as well as the whole family. While we cannot remove said felon, we can safely move the child away from any possible harm. This a case of child endangerment, and that’s what we have come to resolve.” The lawyer stated as he walked back to his seat and sat down.
“Defense?” The judge motioned for my lawyer to get up. She was confident as she walked to the jury and began to talk.
“This isn’t a case of child endangerment, it’s a family dispute about the child in disguise. If Mr. Wanger had taken the time to look into Christian Myers he would see that, Christian has become an upstanding citizen. He was released of good behavior, got a good paying job, got an apartment and started to live a life again. While Mr. Wagner would have you believe that he wants to keep his child safe, he has managed to avoid the topic that he left both the mother and the baby before the baby was born. He didn’t call, visit or even leave a message as to way, he simply left and left my client with the baby. He owes child support, and refused to follow his fatherly duties. He only know wants the child because we had sued his family for child support prior and they alluded receiving the serving.” She scorched as she walked back to her seat and sat next to me.
“Do you think this is going to work?” I asked as the judge started to talk about the case a little more.
“I believe so, we just have to show that Scott is unfit to be a parent and that Christian has changed, even if he didn’t commit the crime he was sentenced for it and that holds weight here. When you go up there you’ll have a turn to speak out, but Scott is going to go first for strategic reasons.” She explained as Scott took his oath to tell the truth and nothing but the truth.
“Why?”
“He’s going to have to avoid that he left you both, didn’t pay child support and that Christian is still a criminal which isn’t probable since I’ve talked to everyone and they said even before his conviction he was the perfect neighbor, the accusation shocked the whole town.” She explained as she turned to watch the questioning begin.
Scott barely said anything, he answered basic questions, how we met, what we agreed to do, and how he found out about Christian. I could see my lawyer baring a wide grin as she got up to question Scott.
“Can you tell me why you weren’t with my client when she met Christian?”
“I was at home.”
“Because you never came back to her house after college right?”
Scott hesitated, “Yes.”
“You didn’t come to the hospital when the baby was born either did you?”
“No.”
“The people would like to submit evidence 2 for review,” She said as she walked over and pulled out papers from his breifcase. “Can you tell me what number this is Scott?”
“It’s my number.”
“It looks like my client called you about twice every day for the first six months that the baby was alive and two months prior to that. Did you answer any of these calls after the baby was born?”
