Following Tali

54 - Testing

Today was finally the day, Gracie was already a month old and Annie (Abby's baby) was 5 months, it had been two weeks since, Jeanne, Tony and Jacey had sent their DNA off for testing. Jacey didn't know why they needed her DNA or who 'Tony' was she just went along with it.

"Zi I'm leaving now" Tony said roughly opening the door

"Okay" Ziva smiled "I love you hairy butt" she said kissing him

"I love you too" he said forcing a smile

"Gracie loves you too" Ziva added as Gracie smiled kicking her feet "Tony she's smiling" Ziva grinned

"Aw baby's first smile" Tony cooed tickling little Grace's chin "See you tonight" He said closing the door behind him

"Hello Jeanne" Tony greeted coldly, it was already 10 and Jeanne had been almost 40 minutes late for their appointment "What took you so long" he asked

"Not much didn't want to get out of bed" she shrugged as though she didn't even care, honestly she probably didn't

"Anthony DiNozzo and Jeanne Benoit" The doctor asked looking around for Jeanne "Nice to meet you" He smiled greeting her, he already introduced himself to Tony when he arrived, Jeanne didn't reply so he ushered them into his office

"I see you didn't bring Jacey with you" He said, shuffling his papers

"No, she had school" Jeanne said rolling her eyes at him

"Oh, well let's start" He sighed turning to the right page "Jeanne Benoit is definitely the mother"

"well obviously" she sighed smirking about what was going to come next

"And Anthony DiNozzo is definitely" he paused "The father"

"What" Jeanne explained

"I'm her father" Tony whispered

"How" Jeanne almost yelled

"You thought I wasn't" Tony asked raising his voice

"Well obviously" she sighed rolling her eyes at him "Whats Jack gonna think" she groaned

"I don't know who 'Jack' is" Tony sighed at her "But I want to meet Jacey" he yelled at her now furious that Jeanne didn't actually believe he was the father she just wanted to mess with him

"Jack is her father" Jeanne yelled "You can't see her" she declared grabbing her coat and walking out

"Great" Tony sighed placing his head in his hands

"Not much I can do" The doctor sighed "I can only give you this leaflet on custody hearings" He said passing Tony a greenish leaflet

"Thanks" Tony said, leaving

"Hey" Tony sighed walking through the front door

"Hey" Ziva smiled "Didn't go as planned" she asked

"Nope, Jeanne was late, she didn't bring Jacey" he sighed, taking a deep breath "She's mine" he said wincing, scared for Ziva's reaction

"It's okay" Ziva said shocking Tony "When do you get to meet her"

"I don't" he stated

"What" Ziva asked, almost yelling

"Jeanne won't let me" he said picking up Gracie who was starting to cry

"You have to fight her" Ziva said

"I will, the doctor gave me this" he said holding the leaflet up "It says how to go for custody" he said cooing at Gracie and tickling her "I have to start with a letter"

Tony put Gracie in her rocker and started to write

Dear Jeanne,

I would like to start contact with our daughter, Jacey, it's unfair to both me and her, she's living her life without her biological father and I'm living with only three out of my four daughters.

If you do not give me contact with Jacey I will have to take legal action against you.

He decided to keep it short so he only wrote what he believed was the most important then made sure he had his own copy, he took Gracie out for a walk and posted it on the way.

It had been over a month now and there was still no reply from Jeanne so Tony was taking it up with the courts, he got himself an attorney and was meeting with him for the first time

"Hey, nice to meet you" Tony smiled shaking hands with the attorney and sitting at there kitchen table, Ziva was working, Gracie was sleeping in a rocker in view and Tali was in her room in bed with a fever

"Nice to meet you" The attorney said "My name's John" "I read through your email, can you elaborate" he asked sipping the tea Tony gave him

"Okay" "Two months ago I was in hospital with my girlfriend who was giving birth when I ran into my ex from almost 15 years ago, she practically said I had another daughter" "We arranged to go for dna testing which came back positive, she said that she never thought I was the father and another guy called 'Jack' was and left, I wrote her a letter explaining how I wanted to see our daughter but she didn't reply"

They spoke for another two hours discussing the case then Tali came down and interrupted them

"Who's Jacey" she asked sniffling

"It's no one Tali" Tony smiled pulling her onto his lap "This is John, you might see him for a while"

"Okay" Tali said snuggling into Tony's shirt

"Who's this" John asked smiling at Tali

"Tali" She whispered

"That's a beautiful name" he smiled "Is Gracie, your little sister" he asked

"Yeah" she whispered smiling

"She looks just like you" he smiled standing up "It was nice to meet you Tony, I'll be in touch" John said shaking Tonys hand and following Tony to the door

"Thank you" Tony smiled.

They spent the rest of the day playing games together and playing with Grace. At 5 Ziva came home with Wendys donuts to make Tali feel better.
